Hypersens Sp. z o.o. based in Toruń, hereinafter referred to as the Manufacturer, ensures that the devices it produces meet the current quality and safety standards and comply with applicable laws.
The Manufacturer provides a warranty for the device along with its components installed in the device and listed in the documentation. The Manufacturer grants a quality warranty for the device for a period of 12 months from the date of sale.
Defects discovered during the use of the device will be repaired at the Manufacturer’s expense.
The warranty does not cover maintenance and inspections of the device related to its use.
The warranty does not cover devices with mechanical or electrical damage caused without the participation of the Manufacturer, in particular:
5.1 Damage incurred during transportation.
5.2 Damage resulting from improper installation and commissioning of the device by the purchaser.
5.3 Damage resulting from improper use of the device, use not in accordance with the user manual or not in compliance with safety rules.
5.4 Damage resulting from unstable power supply.
5.5 Damage resulting from the use of the device (concerning hydrostatic probes and pressure transmitters) in conditions for which the product is not resistant [the description of materials for individual products can be found in the technical documentation].
5.6 Damage caused by random events, such as:
5.6.1 Fire.
5.6.2 Lightning strike.
5.6.3 Explosion.
The warranty does not cover devices that have been modified, altered, changed, or repaired by persons other than the Manufacturer.
Claims regarding the technical parameters of the device are not covered by the warranty if they conform to the parameters specified in the device’s documentation.
The Manufacturer is not liable under this warranty if the repair cannot be carried out due to:
8.1 The introduction of new legal standards.
8.2 Unforeseen circumstances that prevent it.
The Manufacturer is not liable under this agreement in the event of import/export restrictions imposed on the spare parts of the device.
The purchaser may exercise their rights under this warranty if, at the time of requesting warranty service, they:
10.1 Present the warranty document (proof of purchase).
10.2 Provide the malfunctioning device.
Warranty repairs are carried out at the Manufacturer’s premises.
The purchaser of the device is obliged to send the malfunctioning device to the repair site along with an indication of:
12.1 The faults in its operation.
12.2 Damage caused by normal use.
12.3 The Manufacturer covers the cost of shipping the device within the territory of the Republic of Poland.
Any damages resulting from the transportation of the malfunctioning device to the Manufacturer’s premises are not covered by the warranty and are the responsibility of the purchaser.
The Manufacturer is not responsible for the loss of the device during transportation.
The malfunctioning device sent to the Manufacturer for warranty repair must meet basic hygiene conditions.
15.1 Any actions taken by the Manufacturer related to cleaning the device will be performed for a fee.
15.2 The performance of the warranty repair will depend on the payment of this fee.
Warranty repair will be carried out within a period not exceeding 21 days from the date of receipt of the malfunctioning device by the Manufacturer.
16.1 This period may be extended, but this requires prior agreement with the purchaser.
The replacement of the device with a new one will be possible in the case of:
17.1 Two instances of the same defect reported by the purchaser.
17.2 The withdrawal of the model from production (in this case, the Manufacturer will replace the device with another one with parameters similar to the replaced device).
The replaced device or its components replaced under warranty become the property of the Manufacturer.
The purchaser’s rights under the warranty do not include claims for lost benefits due to the device’s malfunction.
The Manufacturer is not liable for any health damage resulting from improper installation or use of the device.
In matters not regulated by this document, the relevant provisions of the Civil Code shall apply.
